Pending Class Action Lawsuits JCM PARTNERS, LLC, MEADOW GARDENS II APARTMENTS, DRIFTWOOD APARTMENTS, VILLA VERDE NORTH APARTMENTS, MICHAEL VANNI, GAYLE ING, BRIAN REIN, et al. Unlawful retention of Security Deposits. The lawsuit alleges that the defendants own/operate and manage over 5,200 apartment units throughout Northern California and that Defendants unlawfully retain security deposits as well as engage in other unlawful rental practices as prohibited under California Civil Code Section 1950.5, et seq. The suit is brought on behalf of all of Defendants' renters, past and present, who were subjected to paying defendants' $250.00 remarketing fee upon early lease termination, and/or all of Defendants' renters who were made to pay late rent charges, and/or all Defendants' renters who were not provided with notice of their right to a post vacating inspection and the right to be present and elect to clean/repair, and/or all Defendants' renters who were not provided with defendants' written security deposit dispostion statement within twenty one days of vacating the premises. The lawsuit also alleges that defendants violate Civil Code 1950.5(e) by retaining tenants' security deposits in payment of the liquidated damages and collection costs. The lawsuit seeks a declaration that the late rent and remaketing fees are unlawful liquidated damages provisions under California Civil Code Section 1671 and enjoining the use of the provisions in its contracts and enjoining them from enforcing the provisions and/or collecting the fees, in addition to an order disgorging Defendants from all liquidated damages received, an order of restitution to all renters who were made to pay the unlawful fees and an order returning unlawfully withheld security deposits, in addition to payment of the attorney's fees and costs incurred in bringing suit against defendants. Leavitt, United States Secretary Health and Human Services - Class action lawsuit alleges that the secretary allows its medicare seconary payer (MSP) contractors to indefinately retain beneficiaries' third party settlement proceeds without due process of law by, among other things, allowing the contractors to determine the amount of a MSP claim soley by review of "codes" and not medical records, and then when the amount is called into question, allowing the contractor to rely solely no the codes and not require the contractor to "demonstrate" the relatedness through medicare records evidence. The complaint further alleges that the secretary allows the contractors not to observe timing regulations and policies when it allows the contractors to withhold payments determined due for as long as a year at a time. The plaintiff also alleges that the secretary violates beneficiaries due process rights when it requires them to sign over to medicare their entire third party settlement proceeds (both known MSP related and non-MSP related) whenever medicare is named as a co-payee. The complaint seeks to enjoin these practices and further to pay reasonable attorneys' fees and costs in having to litigate the matter.
